Mammoth Nation, LLC ("Mammoth," "we," "us," or "our," as the context requires) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.

This Privacy Policy describes our current policies and practices with regard to information that we may collect from you or that you may provide when you visit https://mammothnation.com/ (the "Site" and together with all products, content, functionality and services offered on or through the Site, the "Services") and our practices for collecting, using, maintaining, protecting, and disclosing that information. We respect the privacy of the visitors and users of the Services (“you” or “your,” as the context may require) and we are committed to protecting your privacy and the security of your personal information through compliance with this Privacy Policy.

By accessing or using the Services, by communicating with us regarding the Services, or by clicking to accept or agree to this Privacy Policy when this option is made available to you, you agree to be bound and abide by all applicable laws and regulations, this Privacy Policy and our Terms of Use (together with this Privacy Policy, the "User Terms"), incorporated herein by reference. If you do not want to agree to the User Terms, you must not access or use the Services.

Your continued use of the Services after we revise this Privacy Policy or the User Terms means you accept this Privacy Policy and the User Terms as amended, so please check this Privacy Policy and the User Terms periodically for updates.

What this Privacy Policy Covers

Except as otherwise provided in this Privacy Policy, "Personal Information" is information by which you may be personally identified, or that relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with you, such as name, email address or identification number. "Personal Information" does not include information which is generally not considered "personal information," "personal data" or similar terms under applicable law, such as information which is publicly available or which is subject to special data privacy laws and/or regulations, such as "protected health information" covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

Except as expressly provided in this Privacy Policy, this Privacy Policy does not apply to information that:

  • except as required by applicable law, we collect offline;
  • is collected through any third-party applications or websites other than those included in the Services, including websites you may access through or may be linked to by the Services; or
  • you provide to or which is collected by any third party.

Related offerings with links from the Services may have their own privacy policies. If you visit any other app, website, or third party that we mention or link to, be sure to review its privacy policy before providing it with any information, as that privacy policy will apply to your interactions with that app, website, or third party.

We may use and disclose anonymized or aggregated information about our users, and other information that does not identify any individual, without restriction.

Children's Privacy

The Services are not directed to nor intended for use by anyone under eighteen (18) years of age ("Unauthorized Users"). We do not knowingly collect Personal Information from Unauthorized Users. No Unauthorized Users may use the Services. If you are an Unauthorized User, do not use or provide any Personal Information to, on, or through the Services.

If we learn that we have Personal Information from an Unauthorized User, we will take steps to delete that information from our systems. If you are a parent or guardian and have concerns that we may have collected Personal Information from your child, please contact us as described below.

Information We Collect

We collect several types of information from and about you as a result of your use of the Services and as a result of your communication with us, including:

  • Various categories of Personal Information, such as your:
    • Identifiers, including your name, email address, address, phone number, login credentials (such as username and password), and other similar identifiers.
    • IP address and other unique device identifiers.
    • Financial information such as your credit card and debit card information.
    • Commercial information regarding records of your transactions with us, such as your purchasing history.
    • Internet or other similar network activity information, such as information about your internet connection, your equipment, browsing history, and your use of the Services.

We collect this information:

  • Automatically when you use or access the Services.
  • From third parties (for example, vendors who participate in our marketplace).

Information You Provide to Us

The information (including Personal Information) which we collect on or through the Services may include:

  • Information that you provide by visiting the Services, accessing the Services, and filling in forms on the Services. This includes information provided at the time of registering to use the Services, subscribing to our service, or requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, when you report a problem with the Services, or when you otherwise communicate through the Services.
  • Records and copies of your correspondence (including email addresses) if you contact us.
  • Details of transactions you carry out through the Services and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the Services. We accept, but do not directly collect or store credit card or other payment information via the Services. If you make a purchase through the Services, your payment and payment information will be processed by our payment processor—currently Stripe (see https://stripe.com/). Purchases made on or through the Services, as well as any payment information provided in connection with purchases made on or through the Services will also be subject to the privacy policy and any additional terms and conditions of our payment processor (see https://stripe.com/privacy).
  • Your voluntary responses to surveys that we might ask you to complete.
  • Any other information that you include in communications with us or otherwise share directly with us.

Information We Collect Automatically

As you navigate through and interact with the Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Usage details. When you access and use the Services, we may automatically collect certain details of your access to and use of the Services, including traffic data, approximate location data, logs, and other communication data and the resources that you access and use on or through the Services.
  • Device information. We may collect information about your mobile device and internet connection, including the device’s IP address, unique device identifier, and other information such as operating system and browser type.

The information we collect automatically may include Personal Information. If it does not include Personal Information, we may maintain it or associate it with Personal Information we collect or receive in other ways. It helps us to improve the Services and to deliver a better and more personalized service, including by enabling us to:

We also utilize third-party cookies and other third-party tracking technologies from third-party analytics providers to help us market, troubleshoot, and provide information about our products and services. We use analytics tools provided by third parties including, but not limited to, Google Analytics, which is a third-party service that tracks and reports user behavior and traffic data to Google services in the United States. We use the reports provided by Google and similar service providers to help us understand trends and other activity on the Services and to help us improve the Services. We only use this information to identify trends and potential issues; we do not use it in a way that individually identifies any of our users. Google may use the collected data to contextualize and personalize the ads of its own advertising network. We use the Meta Pixel on our website to track user activity and improve our advertising. This may include collecting information such as IP address, browser type, and pages visited. We will not sell or share your personal data with Meta for purposes other than those outlined in our privacy policy. You can opt-out of this tracking by adjusting your browser settings or using the ad settings on Meta's platform.

This Privacy Policy applies to our website and our mobile app, Mammoth Nation. The app may collect information similar to that collected on our website in addition to in-app purchases.

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the Services may be served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the Services. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. Information We Collect From Third Parties

In some cases, and to the extent permitted by applicable law, we may also receive information (including Personal Information) from third parties or from third-party sources. For example, we may receive mailing lists from vendors who participate in our marketplace in order to promote their participation.

We use information that we collect about you or that you provide to us, including any Personal Information:

  • To provide you with the Services, all related content, and any other information, products, or services that you request from us.
  • To communicate with you and to process your requests.
  • To fulfill any other purpose for which you provide it, such as providing you the benefits associated with your membership.
  • To provide you with notices about your account and/or membership, including expiration and renewal notices.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To market to you and notify you of changes or additions to the Services or any other products or services we offer.
  • To help maintain the safety, security, and integrity of the Services, as well as our products, services, databases, and other technology assets.
  • For testing, research, analysis, and development, including to understand our audience, develop and improve new products and services, and to develop and improve the Services and Mammoth.
  • To respond to law enforcement requests and, as required by applicable law, court order or governmental regulations.
  • To evaluate, negotiate, or conduct a merger, divestiture, restructuring, reorganization, dissolution, other sale, or transfer of some or all of our assets, or the negotiation thereof, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding in which Personal Information held by us about our users and customers is among the assets transferred.
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

We may also use your information to contact you about our own and third-party goods and services that may be of interest to you. If you do not want us to use your information in this way, you may contact us as provided below. Please be advised that members cannot opt out of receiving certain promotional emails from us, but you may request to terminate your membership and no longer receive such promotional emails. Please note that you may unsubscribe from our newsletter emails via the unsubscribe link in the footer of our emails and may be able to change certain payment information through your account settings on the Services. Disclosure of Your Information

We may disclose Personal Information that we collect or you provide:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, advisors, and other third parties we use to support our business. For example, we may disclose Personal Information to service providers who provide us with customer relationship management or marketing software and/or services.
  • To an actual or prospective buyer or other successor in the event of an actual or proposed merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Mammoth's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding in which Personal Information held by Mammoth about users of the Services is among the assets transferred.
  • To third parties to market their products or services to you if you have not opted out of these disclosures. For more information, see Choices About How We Use and Disclose Your Information.
  • To fulfill the purpose for which you provide it, such as when you make a purchase from a third party on the Services, including from a seller selling products. By making the purchase, you are directing us to share your information in this way. These third parties may use the Personal Information shared in accordance with their privacy policies.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your Personal Information:

  • To comply with applicable compliance requirements or with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To detect, prevent, or otherwise address fraud, security, or technical issues.
  • To enforce or apply our Terms of Use and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Mammoth, our customers, or others.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the Personal Information you provide to us. We have gathered the following mechanisms to provide you with the following control over your information:

  • Tracking Technologies. You can set your browser to refuse or disable browser cookies, or to alert you when cookies are being sent. If you refuse or disable cookies, please note that some parts of the Services may then be inaccessible or not function properly. Note that the Services do not currently respond to “do not track” (DNT) signals.
  • Device Permissions. Mobile devices offer permission systems for specific types of device data and notifications, such as phone contacts, pictures, location, and push notifications. You can change your settings on your device to either consent to or refuse the collection or processing of the corresponding information or the display of the corresponding notifications. If you disable or refuse certain permissions, the Services may then be inaccessible or not function properly.
  • Google Analytics. You can opt out of having your activity available to Google Analytics by installing the Google Analytics opt-out add-on. For more information, visit https://tools.google.com/dlpage/gaoptout.
  • Promotional Offers from Mammoth. If you do not wish to have your contact information used by Mammoth to promote our own or third parties' products or services, you can opt out by contacting us as provided below. Please be advised that Mammoth cannot opt members out of receiving certain promotional emails from Mammoth’s vendors, but you may request to terminate your membership and no longer receive such promotional emails. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt-out does not apply to information provided to Mammoth as a result of a transaction.
  • Accessing, Correcting, Updating, and Deleting Your Information. To access, correct, update, or delete certain information, you can contact us as provided in below. You can also review and change your Personal Information by logging into the Services and visiting your account profile page. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause that information to be incorrect.

If you do not want your Personal Information disclosed to third parties or used for purposes other than providing you with the services you requested, you may contact us as provided below.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website. Similarly, you can opt-out of receiving targeted ads from members of the Digital Advertising Alliance (“DAA”) on the DAA’s website, https://www.privacyrights.info.

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to this designated address: [email protected]. However, please know we do not currently sell data triggering that statute's opt-out requirements.

Security Measures

Mammoth implements reasonable physical, administrative, and technical safeguards to protect personal data from loss, misuse, tampering, destruction and unauthorized access. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to the Services. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

International Data Transfers

The Services are operated and managed on servers located and operated in the United States. Any information collected through the Services as described in this Policy is stored in the United States. If you are located outside of the United States, please note that we may transfer information, including Personal Information, to the United States, which may not have the same data protection laws as your jurisdiction, and you consent to the transfer of your Personal Information to, and the storage and further processing of your Personal Information in, the United States.

Retention of Personal Information

We retain your Personal Information only for as long as is necessary to fulfill the purposes for which it was collected and processed. To determine the appropriate retention period for your Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we use your Personal Information and whether we can achieve those purposes through other means, and applicable legal requirements.

It is our policy to post any changes we make to this Privacy Policy on this page with a notice that this Privacy Policy has been updated on our home page. If we make material changes to how we treat our users' Personal Information, we will notify you by email to the email address specified in your account and/or through a notice on our home page. The date this Privacy Policy was last revised is identified at the top of this page.
